MySolity GmbH, hereinafter referred to as "MYSOLITY" or "We" or "Us", appreciates your interest in our company and products and your visit to our website and mobile applications (collectively, the "Online Offer").
2. MYSOLITY respects your privacy
The protection of your privacy when processing personal data as well as the security of all business data is an important concern for us, which we take into account in our business processes. We process personal data collected during your visit to our online offers confidentially and only in accordance with legal requirements.

4. Collection, processing and use of personal data
4.1 Processed data categories
The following categories of data are processed:
- Identity data (e.g. name, contact details, photo).
- Education and training data (e.g. higher education/additional qualifications, school/language certificates, academic title)
- Logging and log-in data/logs (e.g. IP address / meta data, user ID, activity logs)
- Evaluations on the part of MySolity about the cooperation that has taken place
- Project interest
- Usage data (e.g. visit statistics)
4.2 Basic principles
Personal data is any information relating to an identified or identifiable natural person, such as names, addresses, telephone numbers, e-mail addresses.
We collect, process and use personal data (including IP addresses) only if there is a legal basis for doing so or if you have given us your consent in this regard, e.g. in the context of a registration.
4.3 We and service providers commissioned by us process your personal data for the following processing purposes:
- Provision of this online offer (legal basis: fulfillment of contract).
- To identify malfunctions and for security reasons or to ensure and optimize data consistency (legal basis: fulfillment of our legal obligations in the area of data security and legitimate interest in the elimination of malfunctions and the security of our offers as well as the elimination of inconsistent data).
- Own and third-party advertising as well as market research and reach measurement to the extent permitted by law or based on consent (legal basis: consent / legitimate interest on our part in direct marketing, as long as this is done in accordance with data protection and competition law requirements).
- Sending a newsletter by e-mail with the consent of the recipient (legal basis: consent).
- Safeguarding and defending our rights (legal basis: legitimate interest on our part in asserting and defending our rights).
- Answering user inquiries via a contact form (legal basis: Overriding legitimate interest on our part in marketing and in improving our products and services, as long as this is done in accordance with data protection and competition law requirements or contract performance).
4.4 Registration
If you wish to use services that require the conclusion of a contract, we ask you to register. As part of the registration process, we collect the personal data (e.g. first name, last name, date of birth, e-mail address, skills, work experience, references) required to establish and fulfill the contract, as well as any other data on a voluntary basis. We mark mandatory data with an *.
4.5 Log files
Every time you use the Internet, certain information is automatically transmitted by your Internet browser and stored by us in so-called log files.
The log files are stored by us for the purpose of investigating faults and for security reasons (e.g. to clarify attempted attacks) for a period of 30 days and then deleted. Log files whose further storage is required for evidentiary purposes are exempt from deletion until the final clarification of the respective incident and may be passed on to investigating authorities in individual cases.
Log files (without full IP address) are also used for analysis purposes; see the section on web analysis. The following information in particular is stored in the log files:
- IP address (Internet Protocol address) of the end device from which the online offer is accessed;
- Internet address of the website from which the online offer was accessed (so-called origin or referrer URL);
- Name of the service provider used to access the online offer;
- Name of the retrieved files or information;
- Date and time as well as duration of the retrieval;
- Amount of data transferred;
- Operating system and information on the Internet browser used, including installed add-ons (e.g. for Flash Player);
- The http-status-code (e.g. "request successful" or "requested file not found").
4.6 Children and young people
This online offer is not directed at children and young people under the age of 18.
4.7 Transfer of data to other responsible parties
Your personal data will only be passed on to other responsible parties if this is necessary for the fulfillment of the contract, if we or the third party have a legitimate interest in the transfer or if you have given your consent. Details on the legal basis can be found in the section Processing Purposes and Legal Bases. Third parties also include other companies of the MYSOLITY Group. If data is transferred to third parties on the basis of a legitimate interest, this is explained in this privacy notice.
In addition, data may be transferred to other responsible parties if we are required to do so by law or by enforceable official or court order.
In the context of contract performance, it is necessary for profile data to be viewed by other companies via this platform in order to select suitable freelancers and to process projects.
Your personal data may also be viewed via this platform by contractors based outside the EEA.
4.8 Service providers (general)
We engage external service providers to perform tasks such as data hosting. We have carefully selected these service providers and monitor them regularly, in particular their careful handling and safeguarding of the data stored with them. All service providers are obligated by us to maintain confidentiality and to comply with legal requirements. Service providers can also be other MySolity companies.
4.9 Disclosure to recipients outside the EEA
We may also transfer personal data to recipients located outside the EEA in so-called third countries. In this case, we ensure before the transfer that either an adequate level of data protection exists at the recipient or that your consent to the transfer has been obtained.
You can obtain from us an overview of the recipients in third countries and a copy of the specifically agreed arrangements for ensuring an adequate level of data protection. Please use the information in the Contact section for this purpose.
4.10. Duration of storage; retention periods
We generally store your data for as long as is necessary for the provision of our online offer and the associated services, or for as long as we have a legitimate interest in continuing to store it (e.g., we may still have a legitimate interest in postal marketing even after a contract has been fulfilled). In all other cases, we delete your personal data with the exception of data that we must continue to store in order to fulfill legal obligations (e.g., we are required to retain documents such as contracts and invoices for a certain period of time due to tax and commercial retention periods).
5. Use of cookies
Cookies and tracking mechanisms may be used in the course of providing our online services.
Cookies are small text files that can be stored on your terminal device when you visit an online offer.

- Conversion Tracking:

The responsible party for the processing of data in connection with the tools is the respective provider. 5.5 Social plugins
We use so-called social plugins of various social networks in our online offer, these are described individually in this section.
When using the plugins, your internet browser establishes a direct connection to the servers of the respective social network. This provides the respective provider with the information that your internet browser has accessed the corresponding page of our online offer, even if you do not have a user account with the provider or are not currently logged in to it. Log files (including the IP address) are transmitted by your Internet browser directly to a server of the respective provider and may be stored there. The provider or its server may be located outside the EU or EEA (e.g. in the USA).
The plugins are independent extensions of the social network providers. We therefore have no influence on the scope of the data collected and stored by the providers of the social networks via the plugins.
For the purpose and scope of the collection, further processing and use of the data by the social network, as well as your rights in this regard and setting options for protecting your privacy, please refer to the privacy policy of the respective social network.
If you do not want the providers of the social networks to receive and possibly store or further use data about this online offer, you should not use the respective plugins.

6. Social sign-in (registration via social networks)
We offer you the option of logging into our online offering using so-called social sign-ins such as LinkedIn and Xing.
To register, you will be redirected to the page of the respective social network, where you can log in with your data there. This has the effect that your account of the respective network is linked to our service. In the process, the information of your public profile there, your e-mail address and the identification marks of your network friends as well as, if applicable, further data will be transmitted to us by the respective social network.
Conversely, the social network used for registration receives your login status, browser information and your IP address. The provider of the social network or its server may be located outside the EU or the EEA (e.g. in the USA).
If you do not want any data transfer to take place between us and the social networks, then do not register via the social registration services, but use our own registration services instead.
7. Newsletter with registration; right of revocation
You can subscribe to newsletters as part of our online offer. We use the so-called double opt-in procedure for this, according to which we will only send you a newsletter by e-mail, mobile messaging services (such as WhatsApp), SMS or push message if you have previously expressly confirmed the activation of the newsletter service to us by clicking on a link in a notification.
If you later decide not to receive newsletters, you can unsubscribe at any time by revoking your consent. The revocation takes place for e-mail newsletters via the link printed in the newsletter, if applicable, in the administrative settings of the respective online offer. 8. Online profile
We will use your data to put freelancers and MYSOLITY employees in contact with each other. For this purpose, we will forward parts of your data within MYSOLITY. Your data will be stored only for the time necessary for the service and as required by law.
All data generated in your online profile is freely accessible to all MYSOLITY employees registered on the platform, but not to users outside MYSOLITY.
After completion of a project by a freelancer, the contracting company has the opportunity to evaluate the freelancer's performance. The evaluation is done by assigning "stars" as well as an optional written evaluation via free text. This data is stored together with the other profile data and is also accessible to the users of MYSOLITY.
9. External Links
Our online offer may contain links to Internet pages of third parties, i.e. to providers not affiliated with us. After clicking on the link, we no longer have any influence on the collection, processing and use of any personal data transmitted to the third party when the link is clicked on (such as the IP address or the URL of the page on which the link is located), as the behavior of third parties is naturally beyond our control. We do not assume any responsibility for the processing of such personal data by third parties.
10. Security
Our employees and the service companies contracted by us are obliged to maintain confidentiality and to comply with the provisions of the applicable data protection laws.
We take all necessary technical and organizational measures to ensure an adequate level of protection and to protect your data managed by us in particular against the risks of accidental or unlawful destruction, manipulation, loss, alteration or unauthorized disclosure or access. Our security measures are constantly being improved in line with technological developments.

Right to information and disclosure:
You have the right to receive information from us about the processing of your data. To this end, you may exercise a right of access in relation to the personal information we process about you.
Right of rectification and erasure:
You can demand that we correct incorrect data and - insofar as the legal requirements are met - complete or delete your data.
This does not apply to data that is required for billing and accounting purposes or is subject to the legal obligation to retain data. However, to the extent that access to such data is not required, its processing will be restricted (see below).
Restriction of processing:
You may request us - insofar as the legal requirements are met - to restrict the processing of your data.
Data portability:
